To fully celebrate the Kadayawan Festival, President Rodrigo R. Duterte, thru Executive Secretary Salvador C. Medialdea, declared August 18, Friday as a Special Non-Working Holiday in Davao City under Proclamation No. 273.
According to the proclamation, “it is but fitting and proper that the people of the City of Davao be given full opportunity to celebrate and participate in this occasion with appropriate ceremonies.”
As the people of Davao City celebrate this festival, employers are reminded to observe and comply with the pay rules for the said holiday.
The pay rules mandate that if the employee did not work, the “no work, no pay” principle shall apply, unless there is a favorable company policy, or collective bargaining agreement (CBA) granting payment on special day.
- For work done during the special day, the workers shall be paid an additional 30 percent of their daily rate on the first eight hours of work. [(Daily rate x 130%) COLA];
- For work done in excess of eight hours (overtime work), the workers will be paid an additional 30 percent of their hourly rate on said day. (Hourly rate of the basic daily wage x 130% x 130% x number of hours worked);
- For work done during a special day that also falls on his/her rest day, he/she shall be paid an additional 50% of his/her daily rate on the first eight hours of work. [(Daily rate x 150%) +COLA]; and
- For work done in excess of eight hours (overtime work) during a special day that also falls on his/her rest day, he/she shall be paid an additional 30% of his/her hourly rate on said day. (Hourly rate of the basic daily wage x 150% x 130% x number of hours worked)
