DAVAO CITY – The Revised Memorandum of Understanding between the Regional Tripartite Wages and Productivity Board XI (RTWPB XI), the Department of Labor and Employment XI (DOLE XI), the National Conciliation and Mediation Board XI (NCMB XI), the Technical Education and Skills Development Authority XI (TESDA XI), and the Land Transportation and Regulatory Board XI (LTFRB XI), on the implementation of DOLE Department Order No. 118-12, was signed by their respective representatives at Apo View Hotel, Davao City on 06 September 2019.
DOLE Department Order No. 118-12, also known as, the Rules and Regulations Governing the Employment and Working Conditions of Drivers and Conductors in the Public Utility Bus Transport Industry, was issued on 13 January 2012 to ensure the protection and welfare of drivers and conductors employed in the public bus transport industry.
It specifically provides the terms and conditions of their employment, which include among others, minimum benefits, hours of work and hours of rest, right to security of tenure, compensation, and occupational safety and health.
In response, the relevant and concerned agencies, namely: RTWPB XI, DOLE XI, NCMB XI, TESDA XI and LTFRB XI agreed to cooperate with each other to ensure the faithful compliance by the public bus transport companies/owners of the provisions of the department order issued by Department of Labor and Employment (DOLE).
On 06 November 2012, the cooperation between the agencies was formalized through a Memorandum of Understanding wherein the role of each agencies were identified for the smooth implementation of the department order.
After almost seven (7) years of implementing the department order, the concerned agencies agreed to review their original Memorandum of Understanding and revise the same if warranted. During a meeting on 06 August 2019, the concerned agencies introduced some revisions to the original Memorandum of Understanding.
The Revised Memorandum of Understanding in the Implementation of DOLE Dept. Order No. 118-12 was signed by DOLE XI Regional Director and RTWPB XI Board Chairman Raymundo G. Agravante; NCMB-XI OIC-Director Aerrine Marie R. Reyes; TESDA XI Regional Director, Engr. Lorenzo G. Macapili, and LTFRB XI Regional Director, Atty. Armand D. Dioso on 06 September 2019. The signing of the document was witnessed by the wage board members of RTWPB XI, namely: the NEDA XI Regional Director and Vice Chairman of RTWPB XI, Maria Lourdes D. Lim; DTI XI Regional Director and Vice Chairman of RTWPB XI, Ma. Belenda Q. Ambi; Labor Representative, Virginia T. Camus; Management Representatives Atty. Bienvenido D. Cariaga and Rulfo V. Asis.
During her closing remarks, NEDA XI Regional Director, Maria Lourdes D. Lim, lauded the signing of the Memorandum of Understanding by stating that “this MOU, which I believe is the first of its kind, executed by the RTWPB-XI and its partners, is indeed trailblazing, and a best practice by this Board.”
Overall, with the signing of the Revised Memorandum of Understanding, the above-mentioned stakeholders have once again committed to work together and become active partners in fulfilling its purpose of ensuring, enforcing and validating the compliance of public bus transport companies/owners to DOLE DO No. 118-12.
